View Full Version : HELP I need legal Help in Marietta GA HELP

All,
I was in an accident over a month ago with my VTX. (corner of Barett PKWY and Canton HYWY) I was rearended by an automobile when I was yielding for an ambulance. The other driver was ticketed, and that is were the drama has started. There was insurance on the automobile but the driver was not. It took 2 weeks to get the policy # then the insurance company didnt want to pay, they finally agreed after 2 more weeks.
During this time I brought my bike to Canton Motorsports for repairs, and this has been an absolute disaster. They promissed me a quote within a week and took 2 weeks after I pushed really hard and I had to aggree to charge a deposit on my amex card to order the parts.
after another week the bike was completed and I went to pick it up. I noticed right away that something was wrong....... the back fender was tilted up @ 20% and you could see the whole tire and some space between the fender. I pointed this out to the service writer and he said it was ok. I said no again and the tech that worked on the bike came out and said it was ok. I continued to insist it was not and the tech brought out the old fender a said see. again I said it wasnt right. I went into the dealer and looked @ a new vtx and there is no space and I pointed this out to the service writer and the tech then came out and Said he was thinking It might be wrong. At this point I am livid. And now the service writer and tech agree somethinbg is wrong. I then demanded to speak to the Service manager and they "didnt have one" So I demanded to speak to the store manager, after waiting 20 minuted I walked over to an employee and he introduced himself. and we went to look @ the bike. He agreed it was wrong and I asked how is this poosible that the tech could not tell the "frame was damaged" and they had no responce .
they said they would look at it today and got a call later that said the tech is off today so it will be saturday.

What can I do now? I have gone over 4 weeks with out a bike for an acident that I didnt not cause and now I have to go back to the insurance company and explain the honda dealer has made a very bad mistake.
to top it off it is Progressive Insurance

Is there anybody who is an avid motorcyle rider and also a lawyer?
I will pay for a consultation

Eric I don't know of an attorney but you can go to a local bike shop and most of the time they have cards and stickers at the counters for just such things. I've seen them but have never had a need (thank God)
You may have to go to your Ins and let them get involved. They don't want to insure a damaged and dangerous bike. They should be able to help you and then subrogate progressive for the expenses.

Stan, swl2020 might be able to help you on the legal end. About Motosports, well they aren't the same dealer they used to be. At one time when they were family owned and that wouldn't have happened. However now they are corporate owned.

Eric, you don't need a lawyer who is a biker, you need a good litigator. This is about the law, not about the bike. Good luck!

A lawyer that rides does have a particular incite on the “loss of consort” if you will, of a biker going down. I work for a law firm (that practices only criminal law) and ask my lead attorney if he knew of someone he would recommend. He did not personally know of such a firm but knew some firms do specialize in bike accidents. I have seen ads in local mags for “biker lawyers” in the area. Full Throttle has them all the time, I just do not have a copy with me. I checked the web site for you, but found no ads for them. If someone has a copy of the mag. maybe they will hook you up with a name. Here are some names I found on the web and I MAKE NO REPRESENTATION WHAT SO EVER about their abilities. All I can tell you is you are better off with a biker or motorcycle specific firm. That is from one of the best lawyers in the biz. (being a good litigator helps) but, so much of a case is handled on the phone and over coffee, good trial lawyers, that ride, may be rare. Try to find one that practices in that area. This is expressly important if it goes to trial. The local boys know each other if you know what I mean.

I am a litigator who happens to ride. I have been doing both for over 30 years. I have represented several of the Board members, and no complaint yet. Thanks

that is exactly the reason the insurance companies 'total' bikes when there is obviously little damage.


I'm surprised they didn't junk this one.
