View Full Version : Got hit by a car need advice.

The other day, on the way to work, I was going through a small intersection and a woman didn't see me and hit me on my bike. I don't think she ran the stop sign, she just didn't see me. It was her fault, she got the ticket, and I am okay. Scrapped up, bruised, and sore, but I am okay. The bike was hit on the left side on the saddle bag and rear fender. I think I jumped off the bike cause I ended up in someones front yard while the bike was in the middle of the road. The bike was damaged some. The handle bars are all bent up, front and back fender damaged, left side floorboard is damaged, windshield shattered and the saddle bag and blinkers are toast. I am getting the bike towed tomorrow to Desoto Honda so the adjuster can check it out. I couldn't tell if there was any frame or fork damage but everything seems to be pretty cosmetic. Do you think this warrents being totaled out? It's a 2005 1300R with about 17,000 miles on it. The adjuster from the other peoples insurance is already trying to get me to make statements and I think I may need a lawyer. I am not trying to take advantage of this situation at all but I feel like I am entitled to have all my medical stuff paid for plus be compensated for the bike if it is totaled or given the money to fix it if it is repairable. Does this seem like too much to ask? I don't want to sue anyone or go to court I just want to be fairly compensated for my losses. Do I need a lawyer or should I feel safe dealing directly with the other parties insurance company?

Any advice will be very appreciated.

We signed up for A.I.M. (Aid to Injured Motorcyclists) at the Midsouth Motorcycle Show. It was free and they gave us a registration card. Don't know if you have to be signed up to get service or even if it's any good or not. Hope I never get put in that spot to find out but here's the info.

i would talk to your insurance agent. they can and should answer your questions, after all they are in the business to serve their customers. besides that if they give you bad information and advice they could end up flipping the bill. and yes you should get fully compensated. i would check with your insurance and see if you have uninsured motorest and get them to pay then they can recover their money from her insurance.
