South Dakota Driver Faces Charges In Death Of Colorado Man

Bond was set at $1 million Monday for a South Dakota man accused of driving under the influence and slamming into two Colorado motorcyclists, killing one of them.

Garold Lee Fowler, 46, of Hill City, S.D., protested the high bond Monday, saying he was a life-long resident of the area and has a wife and six children.

Magistrate Judge Shawn Pahkle said, "Sir, you're alleged to have killed someone," and said she considered his previous criminal record before setting the bond. If Fowler is found guilty, it would be his sixth lifetime DUI conviction, according to the Rapid City Journal. It would be his third DUI charge in the last 10 years, prosecutors said.

Authorities said Fowler was driving a Chevrolet S-10 pickup on Aug. 3 and rear-ended a Harley-Davidson motorcycle that was stopped to make a left turn between Keystone and Hill City in the Black Hills.

The motorcycle's driver, James Byron Cain, 53, of Englewood, Colo., was killed in the accident. His wife, Judith Buch-Cain, 45, was injured and treated at a Rapid City hospital before being discharged the next day. Both were wearing helmets at the time of the crash, police said.

Fowler is charged with vehicular homicide, vehicular battery and felony driving under the influence.

The Englewood couple was heading to the Sturgis motorcycle rally at the time of the accident. The rally started Monday in Sturgis, S.D., about 50 miles north of the accident site.

"If Fowler is found guilty, it would be his SIXTH lifetime DUI conviction, according to the Rapid City Journal. It would be his third DUI charge in the last 10 years, prosecutors said."

He should have been in jail already. I don't know what the thing is called but after the second DUI they should have to have that thing in the car that you have to breathe into before it will start. If you have alcahol on your breath it will not start. Would save a lot lives.

The world is full of this sShit. The fatal happened 25 miles from my home. The car he ran over couldn't be identified ,it looked like a 1 foot high mat of mashed metal. His driving record includes at least 42 convictions for driving offenses and 19 license suspensions. He was driving on a suspended license when his rig crushed a car being driven by Tina Turcotte, 40, near a construction zone in Hallowell.Turcotte died three days later. Eight days later he was arrested again on charges of operating after suspension, operating an unregistered motor vehicle, illegal attachment of plates and violation of bail conditions that were set after he was charged with driving without a license following the July 29 crash.

attach him to 2 bikes and have a tug of war. when he starts screamin back off just long for him to catch his breath, repeat 10 times then just WOT tell he's done.

don't know how many times I was at the court house where someone had their license taken away and suspended, then walked right out and got in their car and drove away.

Until the law starts to crack down on DUI offenders (my lil brother has three) they are going to continue to be a risk to the communities that we live in.
We have backround checks before buying a weapon, we have drivers test before getting a license of any kind, but we can't seem to keep the people who are not supposed to be driving from driving?
How about, you get caught driving because of a suspended license for some traffic violation, take away the priveledge to drive!!!!

It is comging to a theater near you. Gonna be mandontory on some new vehicles. Unfortunatley, we will have drunks with air bags and drunks paying sober folks to blow for them. maybe even open a cottage industry-breath for drunks... :roll:

Until you get the DRUNK politicians to sign off on legislation, nothing is going to change in the long run. :evil: :evil: Many people will die until it is someone that creates such a public outrage.... :(

A can of compressed air 'used' to work, the newer models are a little smarter.

Repeat Offenders

Perhaps there should be a judicial review of those Judges who failed to permanently revoke Fowlers drivers license and give jail time for the 3rd, 4th, and 5th DUIs. Certainly Judges, like everybody else, should be held accountable for their performance. Consistently do a bad job and you should get fired. I my view the legal system has demonstrated gross disregard for public safety and was criminally negligent in this case.

I guess if he had been a Congressman like Janklow - he would have walked again.

Send the SOB here to Texas. We have an express lane on Capital cases.

I agree...
People should be able to sue the judges who allow repeat offenders off with a slap on the wrist. The relatives of each murdered victim by drivers DUI should be able to sue the judge or remove him from the bench.
