Seeing someone sitting on my motorcycle in my own driveway.

Our neighbors are having their roof replaced. I woke up and went into the kitchen and noticed that three of the roofers were around my motorcycle with one sitting on it and taking pictures. I wasn't happy so I went outside and I told them I didn't want them on my bike. Turns out it was a Spanish speaking only crew. They just laughed and showed me the universal "taking pictures with a camera" and went back to work on my neighbor's roof.

Has anyone else had other people sit on their bikes without their permission? Do you think it's rude? To me it's akin to someone getting into my car and sitting there without my permission.

I can appreciate why you think that. But if not losing it over your personal property, there is no time to ever lose it.
Life is to short and like TennX, I’m older than dirt. Depends on how you see that person….are they kids screwing around or just some people looking for a photo op. Whether someone asks permission or not, I would let them take a seat and photo. Now if they’re there just to rest they’re sorry fat ass or screwing around, I would tell them to move along. The only fear I have with someone just sitting, people are inquisitive and start touching things. Now for screwing around, that’s a HELL no. The fear, someone accidentally knocking it over, breaking something, scratching the paint, etc. It boils down to how they respect someone else’s property.

Will know what Ron White Said,” Can’t fix stupid! In sons of Anarchy. Dude was on his bike the guy as him to take a photo of him on his bike he was happy to and as he took the photo he said this is a before. The guy asked what do you mean before. I’ll let you figure the after.

I think I posted this on VTXOA years ago when it happened.

years ago, when I first got the X I was at the local mall.

I came out of the mall and there was a small child sitting on my motorcycle and his parents were taking pictures. I'm a pretty easy-going guy, and I wasn't really upset about it, however as I approached, I specifically called out to the parents, to be very careful the exhaust pipes are probably very hot.

kid climbed off and yup used the pipes and melted his shoe all over the pipe then burned himself.

parents got irate, called the police not sure what they told the 911 dispatcher, but PD came with the opinion I intentionally harmed the kid.

When I explained my side of the story and showed the officer the melted shoe on the pipe, and he asked to see the pictures on their phone, he determined that they were at fault and wrote up a report for vandalism and vehicle breaking and entering. Forced them to give me their insurance information, and I had the report to back up the damage claim and be sure they couldn't sue me for the kids burns.

got a nice $1,200 check from their insurance. spent a few bucks on a can of BBQ stainless steel cleaner and cleaned off the melted shoe.

personally, I would have walked away with nothing more than "no worries" about the kid being on the bike, but they wanted to escalate it because of their dumbassery so.........

They were lucky, cops could have arrested them for vehicle B&E, it's a felony as far as I know. may not have stuck, but it could have been a lot worse for them.

Personally, I am glad they were charged. Would be happier still if they had lasting repercussions. Personal property is one of the bedrock principles of this country. And for good reason. It definitely sucks to have something like that linger on your record, but without it the parents would surely continue their disregard for their next generation.

(I feel like I'm complaining a lot on this forum recently. I need people to post some problems!)

Downs syndrome kid lived on a friend's street. Every day the D.S. kid would walk past a snarling, barking neighbors dog that stuck it's head thru a hole in the fence. Every day the D.S. kid would kick it in the head and say,"you muth like it. you muth like it. you muth like it. " 8^)

Okay, that's interesting. Since motorcycles do not have any locked "inside", I never knew that sitting on one could be considered B&E. For real? (not being snarky, honestly asking because I teach some of our state penal codes but am really puzzled by this one)
I guess if someone was an azz, someone could really pursue the B&E charges. Though a DA would probably just scoff and dismiss them.
But still, very curious about the MC B&E situation. Would love a law quotation of anybody's got one. Thanks!

As I said before How is it different then sitting inside someones car on the seat, if you leave your door unlocked forgot to lock it one day) and someone gets in is it not still criminal to get inside?

Like I said, probably would not have stuck, DA has bigger things to deal with in CA, but yeah it falls under vehicle B&E. as 69Camaro said no different than getting in someone else's car without permission.

It's just a lack of respect by the general public, and as was said "dumbassery." I used to work in a prison environment and those guys were very sensitive to each other's property and personal space, and I've often thought that some of our citizens in the free world could learn a thing or to from them, sadly.

I've never lived anywhere, nor would I, where I couldn't park my motorcycle inside. I probably would have assumed the worst and come out of the house with a weapon in my hand had that been me.

Be careful not to escalate to deadly force if not necessary. If I see people taking selfies with their phones, I do not assume the worts. But if I see people dismantling my bike, I will absolutely have a gun in my hand and issue commands.
Know your local state laws pertaining to self-defense (defense of a person) and defense of property.

Years ago I was a poor 20 something and I rode an older bike as my only transportation, because it was cheaper on gas and insurance than a car. A month after I had gotten a new helmet some dumbass-parents let their 4 year old kid walk up to my bike while they were talking to some friends. The kid knocked my helmet off of my seat. When the parents noticed they just put the helmet back on the seat and went back to talking. The kid was just being a normal clumsy kid. I wasn't mad at him, but I was pissed at the parents. Who lets their 4 year old walk around a busy parking lot without holding an adults hand? Those asholes can kick rocks.
